TERMS OF SERVICE

WORK STANDARD:
All work is to be completed in a workman-like manner according to standard practices with emphasis on efficient, high quality results. Worker/s will remain on job until completion of project. Work site will be kept clean and orderly throughout the project and upon project completion. All agreements are contingent upon the absence of accidents or delays beyond our control.

INSURANCE:
Home Solutions Kauai carries full general liability and worker’s compensation insurance as specified by state and federal law. Please forward any insurance related questions to homesolutionskauai@gmail.com.

CUSTOMER RESPONSIBILITY:
For your safety, and for production efficiency it is recommended that no one enter work work areas other than Home Solutions Kauai technicians. As with all home improvement projects, children and pets should be kept away from work areas and from Home Solutions Kauai supplies and equipment.

It is ideal for work areas be available exclusively to Home Solutions Kauai, free from other tradespeople, installers, cleaners, etc. While this is not always possible, it does influence the timeline and efficacy of your project being completed. If our working space is interfered with, Home Solutions Kauai may leave the job and additional charges may be incurred.

All alarms must be turned off while work is in progress.

Remove any valuable, fragile or previously broken items from the job site. Items we do not move include Grandfather clocks, Flat Screen TV’s, Valuable or fragile art, or previously broken or fragile furnishings.

Please review this Customer Responsibility List and prepare ahead of time, before our arrival, so that the crew can begin the work as scheduled.

Any customer responsibilities not completed may result in additional labor and material costs and require an Additional Work Order (AWO).

The customer must be available to meet or speak with the Home Solutions Kauai Crew Leader on the last day of the job, to close the project and provide final payment.

COST:
The cost is outlined in your initial project proposal estimate. The quoted price is valid for 30 days, unless otherwise noted.

PAYMENT(S):
All invoices produced shall be due and payable at the time of invoicing according to the terms provided.

Late fees apply 7 days from invoice date: 1.5% per month charge will be added to all open invoices that are more than 7 days past due.

Upon acceptance of a proposal, a deposit in an amount equal to 10% of the contract amount, up to $1,000, shall be required.

PROGRESS BILLING:
All painting and carpentry contract projects shall be billed on a progress billing and payment schedule as follows:

  • Once the project has been scheduled and at the pre-job walk, 50% of the total contract amount shall be collected;

  • Upon mid-point in the scope of work, 25% of the total contract amount shall be collected;

  • Remaining balance due on the last day of the job.

  • Initial deposit amount is deducted from your final invoice.

If you have been quoted an hourly rate for a home project, hours and total rate (+HI state tax) will be provided for you at the completion of the job if project is less than five days. Otherwise payment will be requested for hour totals every Friday.

UNFORESEEN CONDITIONS:
Because of unforeseen conditions, additional repairs/costs may become necessary. The customer will be notified if any such conditions exist at time of discovery and will be provided an Additional Work Order (AWO) to address said repairs.

Examples of unforeseen conditions are: dry rot, moisture damage, high/elevated substrate moisture content, excessive UV damage, dead wood fibers, etc. Should the customer decide to opt out of performing contractor recommended repairs, all areas called out to be repaired are to be excluded from the one (1) year company warranty.

CHANGE ORDERS AND/OR ADDITIONAL WORK ORDERS:
Change orders or additional work orders become part of the contract once the order is prepared in writing and signed by the parties prior to the commencement of any work covered by the new change order or additional work order. The order shall describe the scope of the extra work or change, the cost to be added or subtracted from the contract, and the effect the order will have on the schedule of progress billing.

Performance of Extra Work or Change-Order Work Notice:

  • Home Solutions Kauai is not required to perform additional work or changes without written approval in a “Change Order” or “Additional Work Order” before any of the new work is started.

  • Extra work or a change order/additional work order is not enforceable against a buyer unless the order also identifies all of the following in writing prior to the commencement of any work covered by the new order: The scope of work encompassed by the order. The amount to be added or subtracted from the contract. The effect the order will make in the progress payments (if any) or the completion date.

MARKETING:
Yard Signs: Upon beginning an interior or exterior project, Home Solutions Kauai will display a yard sign on your lawn. Please notify us if it is against regulations with your HOA or if it is something you do not want displayed.

Project Photos: Home Solutions Kauai may take before and after photos of the project to publish on our website or use for other marketing materials. Please notify us if you do not want photos taken of your project.

CUSTOMER SATISFACTION:
At Home Solutions Kauai we raise the bar for quality workmanship and professional service. Customer satisfaction is extremely important to us. At the end of every project, we ask our customers to complete and a job performance review we call our “Service Satisfaction.” Your total and complete satisfaction is our #1 goal. This feedback form is an essential measure to gauge how we are doing.

ATTORNEY’S FEES:
If either party brings legal action to enforce its rights under this agreement, the prevailing party will be entitled to recover its expenses (including reasonable attorneys’ fees) incurred in connection with the action and any appeal.

THREE-DAY RIGHT TO CANCEL:
You, the buyer, have the right to cancel your contract within three business days. You may cancel by e-mailing homesolutonskauai@gmail.com, or texting  808-346-4412 by midnight of the third business day after you received a signed and dated copy of the contract that includes information of your right to cancel.

If you cancel, Home Solutions Kauai will return to you anything you paid within 10 days of receiving the notice of cancellation.

For your part, you must make available to the contractor at your residence, in substantially as good condition as you received it, any goods delivered to you under this contract or sale.
